Introduction

Welcome to La Cabane Trip. These Terms and Conditions (“Terms”) govern your use of our website, booking of our services, and stay at our Surf Lodge. By accessing our website or booking any of our services, you agree to be bound by these Terms.

Business Information:

Please read these Terms carefully before making a booking. If you do not agree with any part of these Terms, please do not use our services.

1. Definitions

  • “We,” “us,” “our” refers to La Cabane Trip
  • “You,” “your,” “guest” refers to the person booking or using our services
  • “Services” includes surf lessons, surf guiding, accommodation at Surf Lodge, excursions, and any other offerings
  • “Booking” means a confirmed reservation for any of our services
  • “Surf Lodge” refers to our accommodation property in Taghazout
  • “Website” refers to lacabanetrip.com

2. Booking and Reservations

2.1 Booking Process

  1. Select your desired service (surf lesson, accommodation, or excursion)
  2. Submit booking form with accurate personal information
  3. Receive booking confirmation and payment instructions
  4. Pay 25% deposit via bank transfer to secure booking
  5. Receive final booking confirmation upon deposit receipt

2.2 Booking Confirmation

  • Your booking is only confirmed once we receive your 25% deposit payment
  • We will send written confirmation via email or WhatsApp
  • You must receive this confirmation before making any travel arrangements
  • Booking confirmation includes: service details, dates, pricing, payment schedule, and important information

2.3 Minimum Age Requirements

  • Surf lessons: Minimum age 5 years
  • Surf Lodge accommodation: Minimum age 18 years (unless accompanied by parent/guardian)
  • Excursions: Minimum age 5 years with adult supervision
  • Maximum age: 70 years for surf activities (health-dependent)

2.4 Group Bookings

  • Groups of 6+ persons may qualify for special rates (contact us)
  • Private group arrangements available
  • Group leader responsible for all group members’ conduct and payments

2.5 Accuracy of Information

You are responsible for providing accurate information including:

  • Full legal name (as on passport)
  • Contact details (phone, email)
  • Physical characteristics (height, weight for equipment)
  • Surf experience level
  • Medical conditions relevant to surf activities
  • Dietary requirements
  • Emergency contact information

False or misleading information may result in booking cancellation without refund.

3. Payment Terms

3.1 Pricing

  • All prices listed on our website are in Euros (EUR)
  • Prices may vary based on season, availability, and booking date
  • We reserve the right to adjust prices at any time; however, confirmed bookings maintain original pricing

3.2 Deposit and Final Payment

  • 25% deposit required to secure all bookings
  • 75% final payment due:
    • Surf Lodge guests: At check-in
    • Surf lessons only: At pickup location
    • Excursions: At pickup location on day of trip

3.3 Accepted Currencies and Payment Methods

  • Currencies: EUR (primary), Moroccan Dirhams (MAD), USD
  • Payment methods: Bank transfer, cash on arrival
  • Bank transfer details provided after booking confirmation

3.4 Late Payment

  • Final payment must be made before service begins
  • Failure to pay may result in cancellation and forfeiture of deposit
  • We reserve the right to refuse service for non-payment

4. Cancellation and Refunds

Please refer to our separate Refund and Cancellation Policy for complete details. Key points:

  • Surf lessons: 48-hour cancellation notice for full refund
  • Accommodation: 14-day cancellation notice for full refund; 7-13 days = 50% refund
  • Excursions: 48-hour cancellation notice for full refund
  • Weather cancellations: Full refund or free rescheduling
  • All cancellation requests must be made in writing (email/WhatsApp)

5. Surf Lessons and Activities

5.1 Safety Requirements

Participants must:

  • Be in reasonable physical health and fitness
  • Be able to swim at least 50 meters
  • Disclose any medical conditions that may affect participation
  • Follow all instructor safety guidelines
  • Not be under the influence of alcohol or drugs

5.2 Health Conditions

You must disclose if you have any of the following conditions:

  • Heart conditions or high blood pressure
  • Epilepsy or seizure disorders
  • Respiratory problems (asthma, breathing difficulties)
  • Back, neck, or joint injuries
  • Pregnancy
  • Recent surgeries or serious injuries
  • Any condition that affects balance, strength, or swimming ability

We reserve the right to refuse participation if we believe it poses a safety risk.

5.3 Instructor Decisions

  • Our surf instructors have final authority on all safety matters
  • They may cancel, postpone, or modify lessons based on conditions
  • They may remove participants who don’t follow safety instructions
  • No refunds for removal due to safety violations or misconduct

5.4 Equipment

  • All surf equipment (surfboards, wetsuits) provided by us
  • You are responsible for equipment care during your session
  • Report any damage immediately
  • Charges apply for negligent damage or loss (see Refund Policy)

5.5 Surf Guiding (Advanced Surfers)

  • For experienced surfers only (intermediate level minimum)
  • No instruction provided, guidance only
  • You surf at your own risk
  • You must follow guide recommendations on spot selection

6. Surf Lodge Accommodation

6.1 Check-In and Check-Out

  • Check-in time: 2:00 PM
  • Check-out time: 11:00 AM
  • Early check-in/late check-out subject to availability (request in advance)
  • Late check-out fee: €20 (if available)

6.2 Room Assignments

  • Atlantic View: Double room, €70/night, private shower, shared toilet
  • Upper Deck Dorm: Mixed dorm (6 beds), €30/night, shared facilities
  • Baya: Single room, €45/night, private shower, shared toilet
  • Minimum stay: 2 nights for all rooms
  • Room assignments based on availability
  • We reserve the right to change room assignments in emergencies

6.3 Maximum Capacity

  • Total lodge capacity: 10 guests
  • No overcrowding permitted
  • Additional guests not included in booking may not stay overnight

6.4 Lodge Amenities

  • Swimming pool (1.5m depth)
  • 2 panoramic terraces with ocean views
  • Gardens with fruit trees
  • Cozy salon/common area
  • 24/7 on-site service
  • Daily housekeeping
  • Towels and linens provided

6.5 Property Rules

To ensure a pleasant experience for all guests:

Prohibited Activities:

  • Smoking inside the lodge (smoking permitted in pool area and gardens only)
  • Excessive noise after 11:30 PM (quiet hours)
  • Parties or events without prior approval
  • Illegal activities or drug use
  • Bringing outside guests without permission

Allowed with Rules:

  • Pets allowed (well-behaved only; meet our friendly dog Toudert first!)
  • Guests responsible for pet behavior and any damage
  • Pet fee: €10 per night

Guest Responsibilities:

  • Respect other guests and property
  • Keep rooms reasonably clean
  • Report any damage or maintenance issues immediately
  • Conserve water and electricity
  • Follow staff instructions

6.6 Meals

Depending on your package:

  • Surf & Stay: 3 fresh Moroccan meals per day included
  • Surf Guiding: 3 fresh Moroccan meals per day included
  • Bed & Breakfast: Breakfast only included

Special dietary requirements accommodated with advance notice (vegetarian, vegan, allergies, etc.)

7. Excursions

7.1 Excursion Details

Paradise Valley (€35-70):

  • Full day adventure to Atlas Mountains oasis
  • Includes transport, guided hiking, lunch, swimming
  • Bring: swimwear, towel, sun protection, comfortable shoes

Sand Dunes/Mini Desert (€35-70):

  • Evening excursion to coastal desert
  • Includes transport, guided tour, Moroccan mint tea, sunset viewing
  • Bring: camera, warm layer for evening

Imsouane Surf Trip (€60-100):

  • Full day to famous surf spot
  • Includes transport, 3-hour surf lesson, lunch, free time
  • Bring: swimwear, towel, sun protection

7.2 Group vs. Private Trips

  • Group trips: Minimum 2 participants required
  • If minimum not met, full refund or option to upgrade to private pricing
  • Private trips guaranteed to proceed

7.3 Excursion Safety

  • Follow guide instructions at all times
  • Stay with the group
  • Inform guide of any medical conditions or concerns
  • We reserve the right to modify itinerary based on safety, weather, or unforeseen circumstances

8. Transportation and Transfers

8.1 Airport/Bus Station Transfers

  • Surf & Stay and Surf Guiding packages: Transfers from Agadir Airport/Bus Station included
  • Bed & Breakfast: Transfers not included (available for additional fee)
  • We will coordinate pickup time based on your arrival details
  • Must provide flight/bus information at least 48 hours before arrival

8.2 Daily Surf Transport

Included in all surf lesson packages:

  • Pickup from your accommodation (if staying elsewhere)
  • Transport to best surf spot based on conditions
  • Return transport after session

8.3 Local Taxi Assistance

  • We can arrange local taxis for your personal trips
  • Guest pays taxi fare directly
  • ATMs, shops, pharmacies, restaurants nearby

9. Liability and Assumption of Risk

9.1 Inherent Risks of Surfing

Surfing is an adventure sport with inherent risks including but not limited to:

  • Drowning
  • Collision with surfboard or other surfers
  • Impact with ocean floor or rocks
  • Marine life encounters
  • Sun exposure and dehydration
  • Cuts, bruises, sprains, or fractures
  • Rip currents and strong waves
  • Weather-related hazards

By participating in surf activities, you acknowledge and accept these risks.

9.2 Assumption of Risk and Waiver

By booking our surf services, you:

  • Acknowledge that surfing involves inherent risks
  • Voluntarily assume all risks associated with surf activities
  • Confirm you are physically and mentally capable of participating
  • Agree that you participate at your own risk
  • Release La Cabane Trip, its owner, instructors, and staff from liability for injuries or damages arising from surf activities (except in cases of gross negligence)

9.3 Insurance

  • We strongly recommend comprehensive travel and medical insurance
  • La Cabane Trip does not provide insurance coverage for guests
  • We have public liability insurance for our operations [TO BE OBTAINED]
  • You are responsible for your own medical expenses
  • Emergency medical services in Morocco may require upfront payment

9.4 Limitation of Liability

To the maximum extent permitted by Moroccan law:

  • La Cabane Trip is not liable for personal injury, death, property damage, or loss arising from your use of our services (except gross negligence or willful misconduct)
  • We are not liable for delays, cancellations, or modifications due to weather, ocean conditions, or force majeure
  • We are not liable for loss or theft of personal belongings
  • Our total liability shall not exceed the amount paid for the specific service

9.5 Guest Responsibility

You are responsible for:

  • Your personal safety and well-being
  • Following all safety instructions and warnings
  • Securing your personal belongings
  • Any medical expenses incurred
  • Damage caused by your actions or negligence

10. Property Damage and Loss

10.1 Accommodation Damage

  • You are liable for any damage to Surf Lodge property caused by you or your guests
  • Report all damage immediately to staff
  • Accidental minor damage: No charge if reasonable wear and tear
  • Significant damage or intentional destruction: Full repair/replacement cost charged

Damage Examples and Fees:

  • Broken furniture: Repair cost or €50-300 replacement
  • Stained or damaged linens: €20-50 per item
  • Broken dishes/glassware: €5-20 per item
  • Wall damage requiring repainting: €50-150
  • Lost room key: €30 replacement
  • Swimming pool equipment damage: €50-200

10.2 Surf Equipment Damage

  • Normal wear and tear: No charge
  • Minor damage (small dings): €20-50 repair
  • Major damage (broken board): €200-400 replacement
  • Lost surfboard: €300-500 replacement value
  • Lost/damaged wetsuit: €80-150 replacement

Payment for damage must be made before checkout or session end.

10.3 Personal Belongings

  • We are not responsible for lost, stolen, or damaged personal belongings
  • Use provided lockers/safes for valuables (if available)
  • Report any theft to us and local police immediately
  • Keep valuables secure and with you at all times

11. Conduct and Behavior

11.1 Expected Behavior

All guests must:

  • Treat staff, instructors, and other guests with respect
  • Follow all property rules and safety guidelines
  • Comply with Moroccan laws and customs
  • Behave in a manner that doesn’t disturb other guests
  • Respect the local community and environment

11.2 Prohibited Conduct

The following behaviors may result in immediate removal without refund:

  • Violence, threats, or aggressive behavior
  • Harassment of any kind (sexual, verbal, physical)
  • Illegal drug use
  • Excessive alcohol consumption affecting behavior
  • Theft or vandalism
  • Disregard for safety instructions
  • Disturbing other guests repeatedly after warnings

11.3 Removal from Property

We reserve the right to:

  • Refuse service to anyone
  • Remove guests who violate these Terms
  • Contact local authorities if necessary
  • Retain payment without refund in cases of serious misconduct

11.4 Cultural Sensitivity

Morocco is a predominantly Muslim country. Please:

  • Dress modestly when outside the lodge 
  • Respect local customs and religious practices
  • Avoid public displays of affection
  • Be respectful during prayer times
  • Ask permission before photographing local people

12. Photography and Marketing

12.1 Guest Photography

  • We may take photos/videos during your stay and surf sessions
  • We will always ask for your permission before taking photos
  • You may opt out of being photographed at any time

12.2 Use of Images

With your consent, we may use photos/videos for:

  • Social media posts (Instagram, Facebook, etc.)
  • Website and marketing materials
  • Promotional content
  • Blog posts and articles

12.3 Your Rights

  • You may withdraw consent for use of your images at any time
  • Request removal of specific photos from social media (we’ll comply within 7 days)
  • Request untagging from social media posts
  • You retain copyright to any photos you personally take

12.4 Social Media Tagging Policy

  • We may tag you on social media if you’re identifiable in photos
  • You may request to be untagged at any time
  • Please tag us @lacabanetrip in your posts (optional but appreciated!)
  • Use hashtag #lacabanetrip to share your experience

12.5 Guest-Created Content

  • You are free to take photos/videos for personal use
  • If you post about us on social media, please:
    • Be honest and respectful
    • Tag us so we can see your content
    • Don’t include other guests without their permission
    • Respect the privacy of staff and instructors

13. Privacy and Data Protection

Your privacy is important to us. Please review our separate Privacy Policy for details on:

  • What personal information we collect
  • How we use your information
  • How we protect your data
  • Your privacy rights (including GDPR compliance for EU guests)
  • Cookie usage on our website

14. Force Majeure

We are not liable for failure to perform our obligations due to events beyond our reasonable control, including:

  • Natural disasters: Earthquakes, floods, tsunamis, severe storms
  • Pandemics/epidemics: COVID-19, disease outbreaks
  • Government actions: Travel bans, border closures, lockdowns
  • Political events: Civil unrest, war, terrorism
  • Infrastructure failures: Power outages, internet disruptions
  • Transportation disruptions: Flight cancellations, road closures

In Force Majeure situations:

  • We will make reasonable efforts to provide alternative arrangements
  • Refunds or credits may be offered (see Refund Policy)
  • Neither party is liable for delays or non-performance
  • We will communicate with you as soon as possible

15. Website Use and Intellectual Property

  • Text, images, graphics, logos
  • Photos and videos
  • Design and layout
  • Trademarks and branding

15.2 Permitted Use

You may:

17. Complaints and Dispute Resolution

  3. We will respond: Within 5 business days with proposed solution
  4. Good faith negotiation: We’ll work together to resolve the matter

17.2 Formal Dispute Resolution

If informal resolution fails:

Step 1: Mediation

  • Both parties agree to attempt mediation
  • Mediator mutually agreed upon
  • Costs shared equally
  • Mediation conducted in Agadir, Morocco

Step 2: Arbitration (Optional)

  • Binding arbitration if mediation fails
  • Single arbitrator mutually agreed upon
  • Arbitration conducted in Agadir, Morocco
  • Decision is final and binding

Step 3: Legal Action

  • As a last resort, disputes may be submitted to courts
  • Governed by Moroccan law
  • Jurisdiction: Courts of Agadir, Morocco

17.3 Time Limit for Claims

Any claims must be submitted within:

  • 6 months from date of service or incident
  • Claims submitted after this period may not be considered

18. Governing Law and Jurisdiction

18.1 Applicable Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Kingdom of Morocco.

18.2 Jurisdiction

Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in Agadir, Morocco.

18.3 Language

These Terms are provided in English for your convenience. In case of any discrepancy or interpretation issues, the English version shall prevail.

19. Amendments and Updates

19.1 Right to Modify

We reserve the right to modify these Terms and Conditions at any time. Changes may be necessary due to:

  • Any booking confirmation documents
